Colorado Consumer Privacy Act Compliant

This Privacy Policy describes how Audibin LLC (Audibin, we, us, or our) collects, uses, discloses, and protects personal information in connection with our platform and services. This Policy applies to all users of the Audibin platform, including listeners and artists.

Colorado residents have specific rights under the Colorado Privacy Act (CPA), C.R.S. ยง 6-1-1301 et seq., which are described in Section 8.

1. Information We Collect

1.1 Information You Provide

  • Account registration information (name, email address, username, password);
  • Artist account information (artist/band name, biography, payment information, tax forms);
  • Payment information (processed through third-party payment processors; Audibin does not store full payment card numbers);
  • Communications you send us (support requests, feedback, correspondence).

1.2 Information Collected Automatically

  • Usage data (songs streamed, listening duration, features accessed, interactions);
  • Device and browser information (IP address, browser type, operating system);
  • Log data (access times, pages viewed, referring URLs);
  • Cookies and similar tracking technologies, as described in Section 6.

1.3 Information from Third Parties

  • If you create an account using a third-party service (e.g., Google or Apple sign-in), we receive basic profile information from that service;
  • Payment processors may provide transaction confirmation data.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the Audibin platform and services;
  • Process payments and distribute compensation to artists;
  • Personalize your listening experience and generate music recommendations;
  • Communicate with you about your account, subscription, and platform updates;
  • Respond to support requests and resolve disputes;
  • Comply with legal obligations, including tax reporting requirements;
  • Detect, investigate, and prevent fraudulent or unauthorized activity;
  • Analyze usage trends to improve platform features and performance.

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • Service providers: We share information with trusted third-party vendors who assist in operating the platform (e.g., payment processors, cloud hosting providers, email delivery services), subject to confidentiality obligations;
  • Legal compliance: We may disclose information when required by law, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights or the safety of others;
  • Business transfers: In connection with a merger, acquisition, or sale of assets, your information may be transferred to the successor entity;
  • Artist public profiles: Certain artist information (name, biography, uploaded content) is publicly visible on the platform;
  • Aggregated data: We may share aggregated, de-identified data that cannot reasonably be used to identify you.

4. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, maintain your account, comply with legal obligations (including tax record-keeping requirements), and resolve disputes. When information is no longer needed, we delete or anonymize it in accordance with our data retention schedule.

5. Data Security

We implement reasonable technical and organizational measures designed to protect your personal information against unauthorized access, disclosure, alteration, and destruction. However, no security system is impenetrable, and we cannot guarantee the absolute security of your information. You are responsible for maintaining the security of your account credentials.

6. Cookies and Tracking Technologies

We use cookies and similar technologies (such as local storage and pixel tags) to operate the platform, remember your preferences, and analyze usage. You can control cookie settings through your browser, but disabling certain cookies may affect platform functionality. We do not currently respond to "Do Not Track" signals.

7. Children's Privacy

The Audibin platform is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected such information, we will promptly delete it. If you believe a child under 13 has provided us with personal information, please contact us at help@audibin.com.

8. Colorado Privacy Rights (CPA)

Colorado residents have the following rights under the Colorado Privacy Act with respect to their personal data:

  • Right to Access: You may request confirmation of whether we process your personal data and obtain a copy of that data;
  • Right to Correction: You may request correction of inaccurate personal data;
  • Right to Deletion: You may request deletion of personal data we hold about you, subject to certain exceptions;
  • Right to Opt Out of Targeted Advertising: You may opt out of the processing of your personal data for targeted advertising purposes;
  • Right to Data Portability: You may request your personal data in a portable format;
  • Right to Appeal: If we decline to act on your request, you have the right to appeal that decision.

To exercise your rights, contact us at help@audibin.com or 4282 Greenbriar Blvd Boulder, CO 80305. We will respond within 45 days, as required by the CPA, with one possible 45-day extension. We will not discriminate against you for exercising your privacy rights.

9. Third-Party Links and Services

The platform may contain links to third-party websites or services. This Privacy Policy does not apply to those third parties, and we encourage you to review their privacy policies before providing any personal information.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Policy on our website and updating the effective date. Your continued use of the Service after such changes constitutes your acceptance of the revised Policy.
